WHAT happens when a municipal mayor signs a contract involving money from the municipality without an enabling resolution from the sanggunian?
Well, this is the main issue involved in this case.
Before we begin, let us refresh our memory with the pertinent provision in the Local Government Code.
Section 22 (c) provides that “Unless otherwise provided in this Code, no contract may be entered into by the local chief executive in behalf of the local government unit without prior authorization by the sanggunian concerned. A legible copy of such contract shall be posted at a conspicuous place in the provincial capitol or the city, municipal or barangay hall.”
In other words, before the mayor may sign a contract, the sanggunian must first concur by issuing a resolution giving authority to the mayor to sign the contract.
Sans the enabling resolution, the contract signed by the mayor is nothing but an unenforceable contract.
Accordingly, a mayor entered into a contract with a telecom company binding the municipality to pay to the telecom company a certain amount for telecom services provided.
To make the story short, payment has already been made by the municipality by virtue of the contract.
No problem so far.
Nobody dared question the legal shortcut because in this particular municipality, the family of the mayor reigns supreme, in fact, for several decades now, they have been lording over the administration of the town.
Their voice is the law and nobody has the balls to question that.
But nature has a unique way of solving things.
With advance age comes health complications. Matod pa, di na gyod mapugngan pa, matigulang gyod.
So, despite the infusion of millions and millions of money, plus a parade of top medical experts, the human body yielded to the elements of nature.

Of course, there is a remedy provided by law when rectification is desired.
The Local Government Code provides that ratification is always an option for the sangguniang bayan in order to cure any defect of an unenforceable contract.
Even when there is no enabling resolution, the SB can later on issue a ratification resolution, ratifying and confirming the authority of the mayor to sign the contract.
But this is possible only when the succeeding administration is chummy with the previous administration or when they belong to the same political aggrupation.
As in, all in the same family lang.
But if the succeeding SB is adversarial, and wants to cleanse the previous record of the past administration, then trouble begins for the past mayor.
And this appears to be the case now.
So, atong paaboton ang dugang kalamboan sa maong kaso.
