Pizarras, Subia, Flores and Associates ang nag representar sa mga akusado didto sa korte.
Ang SLAPP mao ang Strategic Lawsuit Against Public Participation ug mao kini ang naka-dismiss sa maong criminal complaint.
Dugang pa niini, nimando ang huwes sa JGY Corporation nga bayran ang mga akusado og P100,000 isip temperate o moderate damages ug P100,000 isip exemplary damages.
Kahinumduman nga nagsugod ang kaso sa dihang gipangkiha ang mga akusado sa pagkuha sa 10 kabuok 2×2 kahoy nga nagsuporta sa mga punuan sa lubi.

“The instant case was filed to harass, vex, exert undue pressured or stifle any legal action that any person, institution or government office has taken in the enforcement of environment laws, protection of the environm ent or the assertion of environmental rights,” pamahayag pa ni Atty. Pizarras uban sa iyang law partner nga si Atty. Ariel Subia.
“In ruling for the accused, the Court found that the instant criminal action brought against the accused led by Barangay Captain Albert Bompat is part of a series of incidents which involve the enforcement of environmental laws and zoning ordinance of Panglao,Bohol.”
“As early as September 6, 2021, Barangay Capt. Bompat set forth the conditions when he issued a barangay certificate in favor of JGY Corporation in its application for a fencing permit that no structure of whatever kind of materials shall be allowed to be established in the entire foreshore area in order to protect the rights of the barrio folk, including the fishermen.”
“Clearly, the purpose of these conditions is to protect the rights of fisherfolk and residents in the preferential use of municipal waters. Thus, the Court concluded that there is no probable cause to hold the accused for trial on the charge of malicious mischief.” (Kahlil Lester O. Camba)
