GI-DISMISS sa korte ang 3-counts kasong Perjury nga gipasaka ni Albur Mayor Don Ritchie P. Buates batok sa magtiayong Antonio O. Salvo ug Eloisa T. Salvo.
Suma pa sa desisyon sa piskalya nga pirmado ni Atty. Ariel S. Selma ug Atty. Bibiana Z. Bautista, “WHEREFORE, in view pf the foregoing, it is hereby recommended that the charges for three (3) counts of Perjury defined under Article 183 of the Revised Penal Code against Spouses Antonio O. Salvo and Eloisa T. Salvo be DISMISSED for lack of evidence to support a finding of probable cause.”
“That we are complaining Mayor DON RITCHIE P. BUATES, Municipal Mayor of Alburquerque for violation of Article III of BILL OF RIGHTS Sec.9 of the Philippine Constitution that states ‘Private property shall not be taken for public use without just compensation’,” matud pa sa Joint Affidavit of Complaint of Respondents.
Na-imbitahan sila sa usa ka committee meeting niadtong Disyembre 20, 2021 nga pirmado ni Senior Board Member Dionisio Victor A. Balite, Ph.D., ang chairman sa Committee on Good Government, Justice and Human Rights sa Sangguniang Panlalawigan.
Si Balite ang bag-ong napili nga bise gobernador nga molingkod sa Hulyo 1,2022.
Suma pa sa findings sa piskalya, dunay 4 ka elements ang Perjury apan sa maong kaso wala ang ikatulong element niini.
Ang ikatulong element mao ang “accused must make a willful and deliberate assertion of a falsehood in the statement or affidavit. A mere assertion of false objective fact, a falsehood, is not enough.
