Ariel S. Selma ug Atty. Bibiana Z. Bautista, “WHEREFORE, in view pf the foregoing, it is hereby recommended that the charges for three (3) counts of Perjury defined under Article 183 of the Revised Penal Code against Spouses Antonio O. Salvo and Eloisa T. Salvo be DISMISSED for lack of evidence to support a finding of probable cause.”

“That we are complaining Mayor DON RITCHIE P. BUATES, Municipal Mayor of Alburquerque for violation of Article III of BILL OF RIGHTS Sec.9 of the Philippine Constitution that states ‘Private property shall not be taken for public use without just compensation’,” matud pa sa Joint Affidavit of Complaint of Respondents.

Ang ikatulong element mao ang “accused must make a willful and deliberate assertion of a falsehood in the statement or affidavit. A mere assertion of false objective fact, a falsehood, is not enough. The assertion must be deliberate and willful. Perjury being a felony by dolo, there must be malice on the part of the accused.” (Kahlil Lester O. Camba)
