3 hurt in demolition of Dumaluan resort gate

THREE persons were hurt as police forced their way thru Panglao’s workers who successfully demolished Marilou Resort’s gate during a tension-filled scene in barangay Bolod, Panglao town yesterday (April 9) despite the fact that a court order for injunction has been issued not to touch the resort’s side.

The sketchy resort’s report did not name yet the identities of those injured.

The owner Richel Dumaluan, daughter of Dr. Doloreich and Marilou Dumaluan who were out of town, and her workers blocked the steel gate under a big acacia tree not to be removed. But to no avail as police, about over 20 of them with anti-riot gears, were stronger than the resort workers. The daughter-owner had to vacate infront of the target gate to get away from harm.

The police led by Panglao chief Destora assisted the implementation of the demolition with presence of legal team led by provincial legal officer Atty. Handel Lagunay, who was determined to carry out the job.

There were about a hundred policemen coming from municipal police force assisting the enforcement of the demolition of a minute guard house and the gate, according to the estimate of a policewoman.

Voluntary guard house demolition started at past 2 p.m. by resort’s workers and assisted by municipal government workers who brought with them a genset.

The counsel of Dumaluan Atty. Alec Lim and Lagunay’s team, including Atty. Dindo Palgan, discussed intermittently for possible amicable settlement but to no avail until several policemen with anti-riot gears/shields appeared.

Lagunay told media interview that the implementation of the court order for the demolition must be done as he and other respondents—-Panglao Mayor Edgar Arcay and Gov. Aris Aumentado —might be cited contempt in court if failed to carry out the order. Lagunay, Arcay and Aumentado are respondents in the Writ of Mandamus filed by a certain Canadian Jacques Chaolie.

Lagunay said in interview that the demolition was carried out upon the court’s order to clear any obstacle of the barangay road access to the beach. The said barangay road has been in the limelight of controversy for years.

The counsel of the Dumaluans, said that there’s a court order, an injunction preventing the police and other concerned not to touch the Dumaluan’s side. And the Dumaluan family showed to the police officers and government lawyers they voluntarily dismantled the guard house and gate panel on opposite site as promised.

The respondents Mayor Arcay, municipal engineer Rogelio Bonao and planning officer Jarius Fuderanan in civil case No.10341 for prohibition with urgent prayer for temporary restraining order and preliminary injunction are “directed not to implement Memorandum Order No. 2023-0829 and Notice of Demolition pertaining to lots 5796 and 5797 owned by the petitioners” Dumaluan spouses.

This came as the Regional Trial Court’s branch 49 presiding judge Josephus Baterna found the petition meritorious.

Memorandum Order No. 2023-0829 and Notice of Demolition were issued by the Panglao mayor in 2023 apparently to carry out the demolition of the road obstacles. (Ric Obedencio)
