House resolution amending the Constitution?

THIS is explosive and a very brutal attempt at emasculating the Philippine Constitution. I am referring of course to the act of the House Committee on Justice to continue with its “mini-trial” on the merits of the impeachment complaint against VP Inday Sara even when Congress is in recess.

This is bawal, this is illegal and this is very unconstitutional.

Consider this.

Section 3(1 and 2) of Article XI on Accountability of Public Officials state that:

“SECTION 3. (1) The House of Representatives shall have the exclusive power to initiate all cases of impeachment.

(2) A verified complaint for impeachment may be filed by any Member of the House of Representatives or by any citizen upon a resolution of endorsement by any Member thereof, which shall be included in the Order of Business within ten session days, and referred to the proper Committee within three session days thereafter. The Committee, after hearing, and by a majority vote of all its Members, shall submit its report to the House within sixty session days from such referral, together with the corresponding resolution. The resolution shall be calendared for consideration by the House within ten session days from receipt thereof.”

Take note of the highlighted phrase “within sixty session days from such referral.”

Now, what did the HOR Committee on Justice do – they passed House Resolution 892 in March 2026 and authorized the Committee on Justice to conduct impeachment hearings against VP Sara during the congressional recess – March 21 to May 3, 2026.

Pwede diay nila usbon o pulihan ang gimando sa Consitution pinaagi lang sa usa ka resolution sa House – HR 892? Definitely NOT, why, because the Constitution is the ultimate law, the so-called fundamental law of the land, in which all laws derived its bases and authority.

This move – holding impeachment proceedings while Congress is in recess – is very highly questionable because under the law (Constitution) the HOR Committee on Justice can conduct hearings only when Congress is in session – and clearly set at 60 session days from referral of the Complaint – and not after 60 days or when Congress is already in recess.

Law expert Atty. Manuelito Luna hit the issue right smack on its head when he pointed this out online and this is now circulating among legal circles and civic groups alike and could be the basis for another petition for certiorari before the Supreme Court.

In fact, some members of Congress have also realized the merit of Atty Luna’s observation and endorsed it – in principle – and are just waiting for the issue to be resolved by the Supreme Court.

This is now the legal issue – can a mere House Resolution amend the Constitution?

The 60-day period set by the Constitution is a legal sacrosanct – it was specifically set there by the framers of the constitution and approved by the Filipino people.

In a recent bulletin, the DFA Secretary was also wondering who gave BBM the wrong – peke – news about Zaldy Co’s arrest. Under normal circumstances, the DFA should be the first to know because this office is precisely our diplomatic link to the world thru our ambassadors and consuls.

So, dapat unta, ang DFA maoy mo-fed ni BBM sa balita unya bahala na og siya mismo ang mo-balita.

But in the case of the peke news about Co’s arrest, mismo si BBM – nga advocate kunohay against fake news – maoy “nasunog” sa sayop nga balita.

In media parlance, kon ibalita nimo ang sayop, ang usual term is “nasunog.” And this is what happened to BBM, nasunog ug napagba pa gyod.

Ang naka-bibo pa gyod kay si BBM ang mibalita sa sayop, pero si Anti-Kler ang mipasabot nganong sakto ug di sayop si BBM bisan pa man kon klaro gyod kaayo nga sayop.
