Naunsa na man nang kalakiha, mas gamhanan pa ang ICC kay sa Philippine government? Di ba sovereign man unta ang Philippines? Unya ang dakpon pa gyod kay an elected official, meaning, gipili sa supreme sovereign – ang mga madlang pipol.<\/p>\n\n\n\n

Unya dakpon lang pinaagi sa order sa ICC nga wala gani dinhi, wa gani magbayad og buhis dinhi ug wa gyoy labot dinhi bisan gamay lang?<\/p>\n\n\n\n

Okay lang unta if those issued warrants of arrest have been convicted of international crimes like piracy, genocide, crimes against humanity like murder, torture or war crimes. <\/p>\n\n\n\n

Yes, the key word here is convicted.<\/p>\n\n\n\n

But they are merely charged – meaning, their guilt has not been proven yet, then, no decision of conviction can be handed down.<\/p>\n\n\n\n

And definitely, they cannot as yet be arrested and imprisoned.<\/p>\n\n\n\n

More so when the warrant is issued by a foreign court, stress is on the word \u201cforeign.\u201d<\/p>\n\n\n\n

Our courts are functioning, in fact, our courts are 125 years old now. And though the wheels of justice often turn very slow, at least its turning, and its working still.<\/p>\n\n\n\n

And those who needed protection almost always seek judicial remedy, because that is how the system works.<\/p>\n\n\n\n

So when a crime is committed here, whether it is criminal, administrative, civil or political, our local courts take jurisdiction over them, not the foreign courts, but the local courts.<\/p>\n\n\n\n

So when Senator Ping Lacson was accused of the murder of Bobby Dacer for example, and a warrant of arrest was issued against him, that was part of the judicial process and it was carried out, though it was all futile because Lacson made himself disappear and refused to face his legal problem.<\/p>\n\n\n\n

Nobody raised a howl because it was local court issuing a warrant for Lacson.<\/p>\n\n\n\n

But for a foreign court to issue a warrant, even when our courts are functioning, and there are attempts to enforce it, then I say that is very, very illegal and highly irregular.<\/p>\n\n\n\n

This actually was the focal issue when a supposed international law expert tried to assert his brilliance over that of Senior Associate Justice Marvic Leonen on the issue of enforceability of the ICC warrant under RA 9851 or the Philippine Act on Crimes Against International Humanitarian Law, Genocide and Other Crimes Against Humanity.<\/p>\n\n\n\n

According to the lawyer, RA 9851 allows the enforcement of warrants of arrest issued by the ICC even if the Philippines has already terminated its membership in the Rome Statute.<\/p>\n\n\n\n

But Leonen disagreed saying RA 9851 merely \u201ccopy-pasted\u201d the substantial aspect of the Rome Statute by highlighting the \u201cmajor crimes\u201d but did not include provisions for the procedural aspect like the process of enforcing arrests and surrenders.<\/p>\n\n\n\n

This means, Leonen said, that RA 9851 is not complete or sufficient and right now, a law is needed to cover not merely the substantive but also the procedural aspect. Of course, this is now mission impossible because the Philippine is no longer a member of the Rome Statute.<\/p>\n\n\n\n

The schooled lawyer, who was reminded not to commit the mistakes of a law student, was forced to admit the accuracy of Leonen\u2019s argument.<\/p>\n\n\n\n

Why is there a frenzy to arrest senator Bato dela Rosa when all that the irong buang nga trililing got was a supposed ICC warrant – nga di gani niya ipa-kita ni bisan kinsa but gi-wara-wara lang?<\/p>\n\n\n\n

The way I see it was the same when a politician sought my legal advice on the controversial Captain\u2019s Peak Resort case before the Ombudsman and got many top government officials suspended for 90 days.<\/p>\n\n\n\n

After reading the documents, I immediately told the politician nga \u201cdili ni legal nga kaso, political nga kaso ni.\u201d<\/p>\n\n\n\n

Meaning – being a political case, the solution is political, not legal.<\/p>\n\n\n\n

So unsa may maayong buhaton, he asked.<\/p>\n\n\n\n

I answered – atong duolon si kuan, so we went to Manila and sought an appointment with him thru channels.<\/p>\n\n\n\n

Not long after, the suspension order was lifted bisan wala pa mo-expire ang 90 days.<\/p>\n\n\n\n

I see the same pattern in the Bato case.<\/p>\n\n\n\n
