THIS is explosive and a very brutal attempt at emasculating the Philippine Constitution. I am referring of course to the act of the House Committee on Justice to continue with its \u201cmini-trial\u201d on the merits of the impeachment complaint against VP Inday Sara even when Congress is in recess.<\/p>\n\n\n\n

This is bawal, this is illegal and this is very unconstitutional.<\/p>\n\n\n\n

Consider this.<\/p>\n\n\n\n

Section 3(1 and 2) of Article XI on Accountability of Public Officials state that:<\/p>\n\n\n\n

\u201cSECTION 3. (1) The House of Representatives shall have the exclusive power to initiate all cases of impeachment.<\/p>\n\n\n\n

(2) A verified complaint for impeachment may be filed by any Member of the House of Representatives or by any citizen upon a resolution of endorsement by any Member thereof, which shall be included in the Order of Business within ten session days, and referred to the proper Committee within three session days thereafter. The Committee, after hearing, and by a majority vote of all its Members, shall submit its report to the House within sixty session days from such referral, together with the corresponding resolution. The resolution shall be calendared for consideration by the House within ten session days from receipt thereof.\u201d<\/p>\n\n\n\n

Take note of the highlighted phrase \u201cwithin sixty session days from such referral.\u201d<\/p>\n\n\n\n

Now, what did the HOR Committee on Justice do \u2013 they passed House Resolution 892 in March 2026 and authorized the Committee on Justice to conduct impeachment hearings against VP Sara during the congressional recess \u2013 March 21 to May 3, 2026.<\/p>\n\n\n\n

Pwede diay nila usbon o pulihan ang gimando sa Consitution pinaagi lang sa usa ka resolution sa House \u2013 HR 892? Definitely NOT, why, because the Constitution is the ultimate law, the so-called fundamental law of the land, in which all laws derived its bases and authority.<\/p>\n\n\n\n

This move \u2013 holding impeachment proceedings while Congress is in recess – is very highly questionable because under the law (Constitution) the HOR Committee on Justice can conduct hearings only when Congress is in session \u2013 and clearly set at 60 session days from referral of the Complaint \u2013 and not after 60 days or when Congress is already in recess.<\/p>\n\n\n\n

Law expert Atty. Manuelito Luna hit the issue right smack on its head when he pointed this out online and this is now circulating among legal circles and civic groups alike and could be the basis for another petition for certiorari before the Supreme Court.<\/p>\n\n\n\n

In fact, some members of Congress have also realized the merit of Atty Luna\u2019s observation and endorsed it \u2013 in principle \u2013 and are just waiting for the issue to be resolved by the Supreme Court.<\/p>\n\n\n\n

This is now the legal issue \u2013 can a mere House Resolution amend the Constitution?<\/p>\n\n\n\n

The 60-day period set by the Constitution is a legal sacrosanct \u2013 it was specifically set there by the framers of the constitution and approved by the Filipino people.<\/p>\n\n\n\n
